Terms & Conditions
Any purchase or possession of tickets for the Art Coast® Food & Wine Festival constitutes the irrevocable acceptance of, and the agreement to be bound by all of the terms and conditions contained herein, by ticketholder as either the purchaser, custodian or bearer of the Ticket(s) (hereinafter referred to as “Holder”, and/or “You”). Holder acknowledges and agrees that the Festival Organizers may, from time to time, modify, add, remove, supplement, amend, update or otherwise revise any or all of the terms and conditions contained herein, without advanced, direct or individual notice to you and such revisions shall, at the sole and absolute option of the Festival, relate back to the date of purchase.
IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, DO NOT PURCHASE AND/OR USE TICKET(S).
ALL SALES FINAL; NO REFUNDS, NO EXCHANGES, NO REPLACEMENTS. If you are unable to attend, tickets may be transferred to another guest. To facilitate a name transfer only, please email us at: ACFWF@saugatuck.com. The staff facilitating the transfer is not able to assist with refunds. All ticket sales are final.
All events, prices, personalities, performances, venues, dates, and times are subject to change without notice. This ticket is non-refundable and will not be replaced or exchanged for any reason whatsoever. No resale may occur without the prior written consent of the Festival Organizers.
AGE REQUIREMENTS
All attendees must be 21+ to drink alcohol. No one under 21 is permitted including infants and small children in child carriers. This policy pertains to all events and attendees must present a valid photo ID. Please drink responsibly.
EVENT CODE OF CONDUCT
Participants shall comply at all times during the Event with the Food & Wine Code of Conduct (currently available at saugatuck.com/art-coast-food-wine-festival/code-of-conduct, subject to change at any time.) All participants – staff, attendees, speakers, sponsors, vendors, exhibitors, and volunteers – at our event are required to agree to and abide by this Event Code of Conduct. Organizers will enforce this Code throughout the event. We expect cooperation from all participants to help ensure a professional, respectful, welcoming, and safe environment for all participants.
INCLEMENT WEATHER/ EVENT CHANGES/FORCE MAJEURE
Festival Organizers shall have no responsibility, financial or otherwise, for Event cancellation, delay, or interruption due to inclement weather, if the Festival or any of its Event(s) is postponed or canceled by the Festival Organizers due to public health and/or safety concerns, or other acts beyond its control, and will not refund Holder in such situations. Festival Organizers are not responsible for lost or stolen articles at the Event. Organizers in their sole and absolute discretion as provided herein. Upon the occurrence of the Event and/or Festival cancellation due to reasons outlined herein, including but not limited to, events outside the Festival’s reasonable control, acts of God, public health emergencies (including, but not limited to, as a result of epidemics and pandemics); riots, wars, insurrection of military power, civil rebellion, production delays, strikes, hurricanes, tropical storms, earthquakes, floods, natural disasters or inclement weather (regardless of severity), any federal, state or local government law, order, or regulation, order of any court or jurisdiction, Festival Organizers shall, at their sole and absolute discretion (a) have the right, but not the obligation, to issue a refund to Holders, OR shall at its sole and absolute discretion, (b) elect to postpone the Event and/or the Festival OR (c) cancel the Event and/or the Festival without further legal or financial obligation or liability to Holder, including the obligation to issue a refund or to reschedule the Event and/or the Festival. Purchasing Tickets pursuant to these terms and conditions subjects the Holder to a high degree of risk relative to possible Event and/or Festival cancellations. If the Festival Organizers elect to issue a refund, an amount equivalent to the face value of Ticket(s) only shall be refunded to the payment method by which the purchase was originally made. Under no circumstances shall Holder be entitled to a refund of any shipping, handling, or other processing fees.
RIGHT TO USE YOUR NAME, VOICE, IMAGE, AND LIKENESS
By using this ticket, Holder hereby grants Festival Organizers and their affiliates and licensees the irrevocable, transferable, perpetual right and license to record (by photograph, film, tape, aural devices, and any other method or device) the Holder’s name, voice, image, and likeness while at the Festival (the “Recordings”) and publish, print, display, or use such Recordings for any and all purposes, in any and all media now known or hereafter devised.
ASSUMPTION OF ALL RISKS
Each ticket holder (“Holder”) voluntarily assumes all risks and dangers incidental to the event for which the ticket is issued (“Event”), whether occurring prior to, during or after the Event. Holder hereby agrees to release Festival organizers, sponsors and Event locations (collectively, “Organizer Representatives”) acting by and through them, from any claim arising from or relating to the Event. Holder expressly agrees to INDEMNIFY AND HOLD HARMLESS the Festival, its directors, officers, employees, volunteers, agents, and representatives from any and all claims, demands, actions, and costs which might arise out of Holder’s participation in the Festival, even though such claims, demands, actions, and costs may have been caused by the negligence of the Festival, its directors, officers, employees, volunteers, agents, and representatives. Festival Organizers are not responsible for lost or stolen articles at the Event.
NO OUTSIDE FOOD OR DRINK POLICY
For the benefit of our local sponsors and vendors, Attendees will not be permitted to bring non-approved outside food or drink into Festival Events under any circumstances.
NO SMOKING POLICY
The festival grounds are a non-smoking and drug-free area, including cigarettes, vaping, marijuana, and electronic cigarettes.
WEAPONS-FREE POLICY
Possession of any dangerous article, including but not limited to, firearms, destructive devices, explosives, slingshots, weapons, tear gas guns, electric weapons or devices, and fireworks, are expressly prohibited at the Festival or Event host property. Holder agrees that this policy is in force, and agrees to comply with the policy, regardless of whether signs prohibiting weapons are posted on the premises of any official Festival Event.
NO PETS ALLOWED. ONLY SERVICE ANIMALS PERMITTED
Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. For more information, please refer to the U.S. Department of Justice.
BAG POLICY
Small personal clutches, purses, fanny packs, or clear plastic/vinyl/PVC bags up to 12” x 12” x 6” are permitted. Outside food and beverages are not allowed, with the exception of factory-sealed water bottles.
ACCOMMODATIONS
If you have a disability and need accommodation in order to participate in the Event, the Riverside Pavilion and Grand Tasting experience are ADA accessible.
DIETARY RESTRICTIONS
For all Riverside Pavilion events, vegetarian options will be available. Due to the size and scope of the event, we are unable to accommodate allergies or specific dietary restrictions. Participating chefs will generally be onsite and available to answer questions regarding ingredients and preparation.
For the Restaurant Showcase, guests are welcome to contact the restaurant directly with any questions or concerns about allergies and dietary restrictions.
For the VIP Collaboration Dinner, we are unable to accommodate allergies, dislikes, dietary restrictions, or substitutions. Chef menus are fixed and final.
For the Hosted Mini-Sessions (involving food) and the Gallery Showcases, you are welcome to contact the venue directly with any questions about ingredients and preparation. Please note that many venues may use outside caterers and detailed information may not always be available.
